Terms

These terms apply when you use ismellnice.com or buy from us. ismellnice is run by Splendeare Lifestyle Limited (“we”, “us”), based in Lagos, Nigeria. By using the website you agree to them. If you don't agree, please don't use the site.

What ismellnice does

ismellnice helps you discover perfumes for your budget, find cheaper alternatives (“dupes”) and see the price and delivery to your location in naira. We sell the perfumes ourselves. When you tap Shop on a perfume with a price, you are buying from Splendeare Lifestyle Limited.

Ordering and payment

  • Add perfumes to your cart and check out with one delivery address. Prices are in naira (₦). The delivery fee for your state is added once per order, and the total is shown before you pay. We hide any price we haven't confirmed in the last 31 days and show “Price not available yet” instead.
  • Payment is by bank transfer through Paystack, a licensed Nigerian payment provider. Paystack gives you account details to transfer the exact total to. We don't take payment on delivery.
  • Your order is confirmed once Paystack tells us the full amount has arrived. If you don't complete the transfer, the order isn't placed and nothing is charged.
  • If we showed a wrong price by mistake, we'll contact you before sending anything, and you can choose to cancel for a full refund.

If something is sold out

We take payment first and then pack your order. Stock moves quickly, so occasionally a perfume sells out after you've paid. If that happens we'll contact you, and you can choose an alternative or a refund for that item. If you don't want an alternative, we start your refund within 48 hours. Refunds go back through Paystack to the account you paid from, and banks can take a few more working days to show them.

Delivery

  • We deliver across Nigeria. The delivery fee and arrival dates depend on your state and area.
  • Arrival dates are estimates, worked out in Lagos time. Orders confirmed after the daily cut-off, on Sundays or on public holidays start the next working day. Weather, traffic or courier delays can make delivery later; we'll keep you updated if that happens.
  • Please check your order when it arrives and tell us straight away if anything is wrong.

Returns and refunds

For hygiene reasons we can't take back perfume that has been opened or used, unless it is faulty. If your order arrives damaged, is the wrong item, or isn't as described, contact us with your order details and a photo, and we'll arrange a replacement or a refund. Your rights under the Federal Competition and Consumer Protection Act 2018 are not affected, and you can also complain to the Federal Competition and Consumer Protection Commission (FCCPC).

Dupes and match scores

A dupe is a perfume that smells similar to another one. Match scores are our own estimate based on notes, scent family and feedback. They are opinions, not guarantees. Scent is personal and how a perfume smells can vary with your skin, the weather and the batch.

Dupes are separate products from different brands. Calling something a dupe doesn't mean it is made, approved or endorsed by the original brand.

Brands and trademarks

Perfume names, brand names and logos belong to their owners. We use them only to identify products. ismellnice isn't affiliated with or endorsed by any perfume brand unless we clearly say so.

Authenticity

Original designer and niche perfumes are sold as originals. Dupes and Middle Eastern perfumes are sold under their own brand names, never as the perfume they are compared to. If you ever doubt a product, contact us before or after you buy.

Other sellers

We may list offers from other Nigerian sellers in future. When an offer comes from another seller, we'll show their name before you buy, and their terms will apply to that order. Sellers can apply on our Become a seller page.

Using the site fairly

You agree not to:

  • copy, scrape or resell our catalogue, prices or match scores in bulk without our written permission;
  • try to break, overload or get unauthorised access to the website or our systems;
  • send us messages that are unlawful, abusive, fraudulent or spam;
  • use the site in any way that breaks Nigerian law, including the Cybercrimes (Prohibition, Prevention, Etc.) Act.

Our content

The design, text, descriptions, scent tags and match scores on ismellnice are ours or licensed to us. You can share links and quote small parts for personal, non-commercial use.

Liability

We work hard to keep information accurate, but the site is provided “as is”. As far as Nigerian law allows, our total liability for an order is limited to what you paid for it, and we aren't liable for indirect losses, or for delays caused by events outside our control. Nothing in these terms limits rights you have as a consumer that can't be limited by law, or our liability for fraud or negligence that causes death or injury.

Privacy

Our privacy policy explains what information we collect and how we protect it.

Changes

We may update these terms as ismellnice changes. The date at the top shows the latest version. Using the site after an update means you accept the new terms.

Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. We'd always rather sort things out by talking first; if we can't, disputes will be handled by the courts of Lagos State.
