Privacy

This policy explains what information ismellnice (“we”, “us”) collects when you use this website, why we collect it, and the choices you have. We follow the Nigeria Data Protection Act 2023 (NDPA) and the guidance of the Nigeria Data Protection Commission (NDPC).

The short version: you don't need an account to use ismellnice, we don't sell your data, we don't use advertising trackers, and when you order we only ask for what we need to deliver your perfume.

Who we are

ismellnice is run by Splendeare Lifestyle Limited, a perfume seller based in Lagos, Nigeria. We are the data controller for the information described here. You can reach us at splendeare@gmail.com or on WhatsApp at +234 813 636 8288.

What we collect

  • Searches and budget picks. When you search for a perfume or ask for recommendations, we record the search text, the result and the time. These records are not linked to your name, email, phone number or device.
  • Shop taps. When you tap Shop, we record which offer you chose, the delivery state you picked and the total shown. Again, nothing that identifies you.
  • Your delivery location. If you choose “Remember this location”, your state and area are saved only in your own browser (local storage). They are not sent to us to be stored. Clearing your browser data removes them.
  • Your orders. When you buy from us, we collect your name, phone number, email, delivery address, what you ordered and how much you paid, so we can confirm the order, deliver it and handle any returns.
  • Messages you send us. If you use the contact form or email us, we receive your name, email address, phone number (if you give it) and your message. If you chat with us on WhatsApp, we see your WhatsApp name and number.
  • Our WhatsApp assistant. If you chat with our WhatsApp assistant, we keep the conversation (your WhatsApp name and number, your messages, the options you tap and your basket) so we can answer you, take your order and let our team pick up where the assistant left off.
  • Technical logs. Like every website, our hosting provider automatically keeps short-lived server logs (such as IP address, browser type and pages requested) to keep the site running and secure.

Payments are handled by Paystack. When you pay by bank transfer, Paystack processes it and tells us whether the money arrived and how much; we never see your bank login or card details. We don't collect your date of birth or any sensitive personal data.

Why we use it, and our lawful basis

  • To run and improve ismellnice (show prices, work out delivery, spot perfumes people search for that we don't list yet). Lawful basis: our legitimate interests, using anonymous data.
  • To take and deliver your order, and handle returns. Lawful basis: performing our contract with you.
  • To reply to you when you contact us. Lawful basis: your consent, and taking steps you asked for.
  • To keep the site secure and prevent abuse or fraud. Lawful basis: legitimate interests.
  • To meet legal obligations where Nigerian law requires us to keep or share information.

We will not use your details for marketing unless you have clearly asked us to.

Cookies and similar technology

Shoppers don't get cookies from us. We use your browser's local storage only to remember your delivery location, and only if you ask us to. Our staff sign-in area uses essential cookies to keep staff logged in. We don't use advertising cookies or third-party tracking pixels.

WhatsApp and other websites

If you chat with us on WhatsApp, Meta's privacy policy applies to the chat itself. If we ever list another seller and you buy from them, that seller's privacy policy applies to the details you give them.

Who we share it with

We don't sell or rent personal data. We share it only with people who help us serve you:

  • delivery riders and courier companies, who get your name, phone number and address to deliver your order;
  • Vercel, which hosts the website;
  • Supabase, which hosts our database;
  • Paystack, which processes payments and refunds (it receives your email, the amount and order number);
  • Meta (WhatsApp), which carries WhatsApp messages between you and us;
  • Resend, which delivers contact form messages to our inbox;
  • Google, which provides our email inbox.

They may only use the data to provide their service to us. We may also disclose information if required by law, a court order or a lawful request from a Nigerian authority.

Transfers outside Nigeria

Some of our providers store data on servers outside Nigeria (for example in the European Union or the United States). When that happens we rely on the safeguards allowed under Part VIII of the NDPA, such as the provider's contractual data protection commitments, so your data stays protected to a standard at least as high as Nigerian law requires.

How long we keep it

  • Order records: as long as Nigerian tax and accounting law requires us to keep them (usually 6 years).
  • Contact messages, WhatsApp chats and replies: up to 2 years after our last exchange, then deleted.
  • Anonymous search and click records: kept while they help us improve the catalogue.
  • Server logs: kept by our hosting provider for a short period, usually days to a few weeks.

Your rights

Under the NDPA you have the right to:

  • be told how your data is used (this page);
  • get a copy of the personal data we hold about you;
  • have inaccurate data corrected;
  • have your data deleted, or its use restricted;
  • object to how we use it, and withdraw consent at any time;
  • receive your data in a common format so you can move it elsewhere;
  • complain to the Nigeria Data Protection Commission (ndpc.gov.ng).

To use any of these rights, email splendeare@gmail.com. We may ask you to confirm who you are, and we'll respond within 30 days. It's free.

Security

We use encrypted connections (HTTPS), limit staff access to what each person needs, and keep admin access behind a password-protected sign-in. No system is perfectly secure, but if a breach puts your rights at risk we will notify the NDPC within 72 hours, and tell you without delay where required.

Children

ismellnice is meant for adults. We don't knowingly collect personal data from anyone under 18. If you believe a child has sent us their details, contact us and we'll delete them.

Changes to this policy

We may update this policy as ismellnice grows. The date at the top shows when it last changed. If a change is significant, we'll say so on the website.
